These Terms and Conditions, together with our Privacy Policy, set out the terms governing your use of the website www.yasmeencreative.com ("Website") and the provision of property marketing services by Yasmeen Creative Limited ("We", "Us", "Our", "the Company").
By accessing this Website and/or placing an order for our services, you ("Client", "You", "Your") agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, please do not use this Website or engage our services.

PART A: GENERAL TERMS
1. Definitions and Interpretation
In these Terms and Conditions, unless the context otherwise requires:
- "Booking" means an order for Services placed via our Website or other means.
- "Client" means the person or entity engaging our Services.
- "Content" means any text, images, audio, video, scripts, code, software, databases, and any other form of information on our Website.
- "Deliverables" means the photographs, videos, floor plans, designs, or other materials produced by Us as part of the Services.
- "Property" means the premises at which Services are to be performed.
- "Services" means the property marketing services offered by Us, including but not limited to photography, videography, floor plans, and design services.
- "Works" means all photographs, videos, floor plans, designs, and other creative outputs produced under these Terms.

5. Access to Our Website
5.1. Access to Our Website is provided free of charge.
5.2. It is your responsibility to make the arrangements necessary to access Our Website.
5.3. Access to Our Website is provided on an "as is" and "as available" basis. We may suspend or discontinue Our Website (or any part of it) at any time without notice. We do not guarantee that Our Website will always be available or that access will be uninterrupted.
6. Intellectual Property Rights (Website Content)
6.1. All Content included on Our Website and the copyright and other intellectual property rights in that Content belongs to or has been licensed by Us, unless specifically labelled otherwise.
6.2. You may access, view, and use Our Website in a web browser and may download Our Website (or any part of it) for caching purposes only.
6.3. You may print one copy and download extracts of any page(s) from Our Website for personal use only.
6.4. You may not use any Content from Our Website for commercial purposes without first obtaining a licence from Us.

PART C: SERVICE TERMS
8. Services Offered
8.1. We provide the following property marketing services:
Capture Services:
- Property Photography (including HDR photography)
- Property Videography (including drone footage where applicable)
- 2D and 3D Floor Plans
Design Services:
- Brand Design (logos, stationery, brand identity)
- Social Media Design
- Print Marketing (brochures, flyers, signage)
- Logo Animation

9. Booking and Order Acceptance
9.1. You may place a Booking via our online booking system or by contacting Us directly.
9.2. By placing a Booking, you are making an offer to purchase Services subject to these Terms and Conditions.
9.3. A Booking is not accepted until We confirm acceptance and payment has been received in full. Upon acceptance, a binding contract is formed between You and Us.
9.4. We reserve the right to refuse any Booking at our sole discretion.
10. Pricing and Payment
10.1. All prices shown on Our Website are in Pounds Sterling (GBP).
10.2. Payment is due in full at the time of booking to secure your appointment. No appointment is confirmed until payment has been received.
10.3. Payment may be made via credit/debit card through our secure payment processor (Stripe) or by bank transfer.
10.4. Prices are subject to change without notice, but changes will not affect Bookings for which We have already received payment.
10.5. Additional Charges: The following may incur additional charges:
- Travel outside Greater London (charged at cost)
- Additional visits to the Property required due to Client's failure to prepare the Property
- Rush delivery requests
- Additional editing beyond the scope of the original Booking
- Reshoots requested by the Client (not caused by Our error)
11. Scheduling and Appointments
11.1. Appointments are available Monday to Friday, between 9:00 AM and 5:00 PM, subject to availability.
11.2. We will make reasonable efforts to accommodate your preferred date and time, but cannot guarantee availability.
11.3. Appointment duration is allocated based on the service booked and property size. Extended time beyond the allocated duration may incur additional charges.
12. Cancellation and Rescheduling
By the Client:
12.1. More than 48 hours' notice:
- First reschedule: Free of charge; your booking fee will be transferred to the new date
- Cancellation: Full refund minus a £25 administrative fee
- Second or subsequent reschedule: 25% of the booking fee will be retained; new full payment required for the rescheduled appointment
12.2. Less than 48 hours' notice:
- 50% of the total booking fee will be retained
- The remaining 50% may be applied to a rescheduled appointment or refunded
12.3. Less than 24 hours' notice or no-show:
- 100% of the booking fee will be retained
- No refund will be provided
12.4. Cancellations and rescheduling requests must be made by email to [email protected] or by telephone.
By Us:
12.5. We reserve the right to cancel or reschedule a Booking due to:
- Illness or emergency affecting our team
- Adverse weather conditions (for exterior or drone shoots)
- Force majeure events
12.6. Where We cancel or reschedule for reasons within our control, you will be offered a full refund or free rescheduling at your choice.
13. Property Access and Preparation
Client Responsibilities:
13.1. You must ensure We have unhindered access to the Property at the scheduled appointment time.
13.2. If access codes, keys, or other entry arrangements are required, these must be provided at least 24 hours before the appointment.
13.3. Property preparation is your responsibility. The Property should be:
- Clean and tidy
- Staged appropriately (beds made, personal items removed or arranged, etc.)
- Well-lit (blinds/curtains open where appropriate)
- Free of obstacles that would prevent photography
13.4. If the Property is not adequately prepared upon our arrival:
- We may proceed with the shoot as-is, without obligation to return for additional shots
- Any additional visits required will be charged at the full service rate
13.5. If We are unable to gain access to the Property within 15 minutes of the scheduled appointment time due to circumstances within your control, this will be treated as a no-show and Clause 12.3 will apply.
Our Responsibilities:
13.6. We will treat the Property with respect and care.
13.7. We will not move heavy furniture or fixtures. Light staging (cushion arrangement, minor repositioning of decorative items) may be undertaken with your permission.
13.8. We will not be liable for any damage that occurs as a result of moving furniture or fixtures at your request.
14. Delivery of Works
14.1. We will use reasonable endeavours to deliver the Works within the following timeframes:
- Photography: 24-48 hours
- Videography: 3-5 working days
- Floor Plans: 24-48 hours
- Design Services: As agreed at booking
14.2. Delivery times commence from the date of the completed shoot or receipt of all necessary materials from you.
14.3. Delivery times are estimates and not guaranteed. We will not be liable for any delay in delivery.
14.4. Works will be delivered electronically via secure download link. Download links expire after 14 days.
14.5. Archival retrieval: Requests to re-send Works after the initial 14-day download period may incur an archival retrieval fee of £50.
14.6. We retain backup copies of Works for 12 months from delivery date, after which they may be permanently deleted.
15. Revisions and Reshoots
15.1. Photography: Basic colour correction and exposure adjustments are included. Extensive retouching or compositing is not included and may be quoted separately.
15.2. Videography: One round of revisions is included. Additional revisions may incur extra charges.
15.3. Floor Plans: Minor amendments to room labels are included. Significant changes to the layout or style may incur additional charges.
15.4. Reshoots: If you are dissatisfied with the Works due to Our error or failure to follow specific written instructions provided at booking, We will undertake a reshoot at no additional charge.
15.5. Reshoots requested due to changes in the Property, Client preference, or circumstances outside Our control will be charged at the full service rate.
PART D: COPYRIGHT AND LICENSING
16. Ownership of Works
16.1. We retain full copyright and ownership of all Works produced under these Terms, including all photographs, videos, floor plans, and designs.
16.2. Copyright in the Works shall remain with Yasmeen Creative Limited unless explicitly assigned in writing.
17. Licence Grant to Client
17.1. Upon receipt of full payment, We grant You a non-exclusive, perpetual licence to use the Works for the following purposes:
Permitted Uses:
- Marketing the specific Property for sale or rent
- Displaying on your website and social media channels
- Uploading to property portals (Rightmove, Zoopla, OnTheMarket, etc.)
- Including in property brochures and marketing materials for that Property
- Internal business use and record-keeping
18. Restrictions on Use
18.1. You may not:
- Sell, sub-license, or redistribute the Works as stock imagery
- Use the Works for purposes other than marketing the specific Property
- Remove or alter any copyright notices, watermarks, or metadata embedded in the Works
- Claim authorship or ownership of the Works
- Modify, adapt, or create derivative works without Our written consent
18.2. If you are an estate agent and are de-instructed from marketing the Property, your licence to use the Works for that Property terminates immediately. Any continued use requires a new licence.
19. Our Use of Works
19.1. We reserve the right to use all Works for:
- Our portfolio and promotional materials
- Our website and social media channels
- Industry awards and competitions
- Press and media features
19.2. If you require confidentiality regarding a Property, you must notify Us in writing before the shoot. We will make reasonable efforts to accommodate such requests, but this may affect pricing.
20. Attribution
20.1. Where reasonably practicable, you shall credit Us as follows: "Photographs by Yasmeen Creative (www.yasmeencreative.com)"
20.2. Attribution is requested but not mandatory for standard property marketing use.
21. Unauthorised Use
21.1. Any use of the Works outside the scope of the licence granted constitutes copyright infringement.
21.2. In the event of unauthorised use, We reserve the right to:
- Issue an invoice for the appropriate licensing fee
- Pursue legal action for copyright infringement
- Seek damages, including but not limited to the market rate for the unauthorised use plus a surcharge of 100%
PART E: LIABILITY AND INDEMNITY
22. Limitation of Liability
22.1. Nothing in these Terms excludes or limits Our liability for:
- Death or personal injury caused by Our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited by law
22.2. Subject to Clause 22.1, Our total liability to You in respect of all losses arising under or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed the total amount paid by You for the Services giving rise to the claim.
22.3. We shall not be liable for any:
- Loss of profits, sales, business, or revenue
- Loss of business opportunity, goodwill, or reputation
- Loss of anticipated savings
- Indirect or consequential loss or damage
22.4. We are not liable for:
- The condition or presentation of the Property
- Delays caused by your failure to provide access or necessary information
- Equipment failure beyond our reasonable control
- Weather conditions affecting exterior or drone photography
- Loss of data due to your failure to download Works within the specified timeframe
23. Client Indemnity
23.1. You shall indemnify Us against all liabilities, costs, expenses, damages, and losses (including legal fees) arising out of or in connection with:
- Your breach of these Terms
- Your failure to obtain necessary permissions for the shoot (e.g., from landlords, tenants, or neighbours)
- Any claim by a third party arising from your use of the Works outside the licence granted
- Any misrepresentation made by you regarding your authority to engage our Services
24. Force Majeure
24.1. We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather conditions
- Pandemic, epidemic, or public health emergency
- Acts of government, war, terrorism, or civil unrest
- Power failures, internet failures, or equipment breakdown
- Industrial action or strikes
PART F: GENERAL PROVISIONS
25. Changes to These Terms
25.1. We may revise these Terms and Conditions at any time. Changes will be effective upon posting to our Website.
25.2. You are advised to check this page periodically to ensure you are aware of any changes.
25.3. The version of these Terms in effect at the time of your Booking shall apply to that Booking.
26. Entire Agreement
26.1. These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between You and Us regarding the Services.
26.2. Any variation to these Terms must be agreed in writing by both parties.
27. Severability
27.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
28. Waiver
28.1. No failure or delay by Us in exercising any right or remedy shall constitute a waiver of that right or remedy.
29. Assignment
29.1. You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without Our prior written consent.
29.2. We may assign or transfer our rights and obligations under these Terms to another organisation.
30. Third-Party Rights
30.1. These Terms do not confer any rights on any person or party other than You and Us.
31. Governing Law and Jurisdiction
31.1. These Terms and Conditions, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales.
31.2. If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in these Terms takes away from or reduces your legal rights as a consumer.
31.3. If you are a consumer, any dispute shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
31.4. If you are a business, any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
32. Complaints
32.1. If you have any complaints about our Services, please contact Us at [email protected].
32.2. We will acknowledge your complaint within 5 working days and aim to resolve it within 14 working days.
PART G: ADDITIONAL TERMS
33. Video Format and Specifications
33.1. For videography services, the Client must specify the required format (Landscape or Portrait) at the time of booking.
33.2. Additional formats requested after delivery will be charged as a new service.
33.3. Music included in videos is royalty-free and licensed for property marketing use only.
34. Drone Photography and Videography
34.1. Drone services are subject to weather conditions and Civil Aviation Authority (CAA) regulations.
34.2. We hold the necessary CAA permissions and insurance for commercial drone operations.
34.3. Drone flights may be restricted or prohibited in certain areas due to airspace regulations. We will advise if this affects your booking.
34.4. If drone footage cannot be captured due to weather or regulatory restrictions, that portion of the service will be refunded or rescheduled at no additional charge.
35. Floor Plan Accuracy
35.1. Floor plans are produced for marketing purposes only and are not to scale for construction or legal purposes.
35.2. While We take reasonable care to ensure accuracy, We do not guarantee the precise measurements or dimensions shown on floor plans.
35.3. Floor plans should not be relied upon for valuation, legal, or contractual purposes.
36. Design Services
36.1. Design services (brand design, social media design, print marketing) are subject to a separate brief and quotation.
36.2. Copyright in bespoke design work transfers to the Client upon full payment, unless otherwise agreed.
36.3. We retain the right to use design work in our portfolio unless you request confidentiality in writing.
